Children: you can make a claim on behalf of your child anytime before they turn 18. Once they turn 18, they would have to make a claim themselves and they have up to 3 years to do this. If the negligence happened when they were 10 years old, they would still have 3 years from turning 18 to make a medical negligence claim.

Mental injuries: if someone is mentally unable, there is no time frame to make a claim.
